What is a cookie?

Cookies are small text strings that the sites visited by the user send to his terminal (usually the browser), where they are stored before being re-transmitted to the same sites at the next visit of the same user. During the navigation on a site, the user can also receive cookies on their terminal that are sent from different websites or web servers (so-called “third parties”), on which some elements may exist (such as, for example, images, maps, sounds, specific links to pages of other domains) on the site that the same is visiting. At each subsequent visit, cookies are sent back to the website that originated them (first-party cookies) or to another site that recognizes them (third-party cookies). Cookies are useful because they allow a website to recognize the user’s device or the user itself, for example when accessing an IT system with authentication credentials. Depending on the function and purpose of use, the Privacy Authority has divided this computer tool into three different types: technical cookies, profiling cookies, third-party cookies.
The two main subdivisions on the subject concern:

  • First-party cookies / third-party cookies: these are the first ones installed directly by the site operator on the User’s terminal, while the latter are installed by a different site through the site manager that the user is by visiting
  • Technical cookies / profiling cookies // this distinction has to do with the aims pursued // are the first those used for the sole purpose of “transmitting a communication on an electronic communication network, or to the extent strictly necessary for the supplier an information society service explicitly requested by the subscriber or user to provide such service “, ex art. 122, paragraph 1 of the Privacy Code; in other words, they are used for the sole purpose of contributing to the proper functioning of the site, or to improve its usability by the User, are not used for other purposes and are normally installed directly by the owner or operator of the site. // Profiling cookies, on the other hand, are aimed at creating profiles related to the User and are used to send advertising messages in line with the preferences expressed by the same in the context of surfing the net.
